Embezzlement is a type of white-collar crime that involves an employee or fiduciary misusing funds or assets entrusted to them for personal gain. This crime can range from minor financial misconduct to large-scale schemes involving significant company funds, and it carries serious consequences, including criminal charges and imprisonment.

The Association of Certified Fraud Examiners analyzed 2,402 cases and found a median loss of $104,000 per case. Asset misappropriation, which includes embezzlement, accounted for 90% of cases.

Embezzlement occurs when someone lawfully entrusted with money or property uses it for their own benefit or the benefit of another person. This can happen in private businesses, non-profit entities, and governments, and it’s not limited to management-level employees.

According to the ACFE’s 2026 study, staff-level employees accounted for 41% of occupational fraud cases, while owners and executives made up 16%. The scale of the fraud increases with authority, with owners and executives causing median losses more than nine times those caused by rank-and-file employees.

Warning signs of embezzlement include documentary evidence, such as unexplained gaps between bank records and ledgers, or vendor invoices that can’t be traced to a delivery. Behavioral signs, such as living beyond visible income or refusing to share duties, can also be indicators of embezzlement.

Most businesses focus on watching people instead of building a system for reporting suspicious activity. Tips from employees accounted for 43% of detections, and speed is critical in minimizing damage. Schemes caught within six months carried a median loss of $40,000, while those that ran for five years or longer exceeded $1.1 million.

A red flag is a reason to examine records, not to accuse someone. Several signs involve an employee’s private financial circumstances, and acting on suspicion alone can expose an employer to defamation and wrongful termination claims.

Embezzlement can have severe consequences for businesses and employees. Financial misconduct can lead to a loss of trust among employees, incidents of harassment or discrimination, and decreased job satisfaction. If the business continues to suffer financially, it may struggle to expand operations or maintain salaries, affecting its image and ability to attract customers and workforce.

An embezzlement conviction can have lasting consequences, including severe social stigma and damage to one’s career. Effective handling of an embezzlement case requires dealing with both the legal and social repercussions of the allegations.

Understanding state laws and definitions of embezzlement can help organizations respond to misconduct appropriately and recognize the seriousness of the charges. This knowledge can also help the accused understand the severity of the charges from the outset.

One way to prevent embezzlement is to use technology that recognizes unusual transactions, providing an additional layer of control that doesn’t depend on individual employees. By taking proactive steps, organizations can minimize their risk of embezzlement and protect their assets, which is especially important for small businesses that may not have the resources to absorb significant losses.
